The basics

Buying Residential Property in India as an NRI or OCI

Eligibility

Who can buy

NRIs and OCIs can generally buy residential property in India under FEMA rules, without separate RBI approval. Agricultural land, plantation property and farm houses need RBI permission.

Payment

How to pay

Payment must come through normal banking channels, for example inward remittance from abroad or an NRE, NRO or FCNR(B) account. Keep the bank records for every payment.

Paperwork

Documents

Expect to share your passport, PAN, address proof and photographs. If you sign from abroad, documents and any power of attorney must be executed and attested as the law requires. Ask your lawyer.

This is general information, not legal or tax advice. Rules change. Please confirm current rules with your bank, a chartered accountant and a lawyer.

Before you pay

What to Check Before You Book

  • The project RERA registration (%s) on rera.wb.gov.in, including the promoter name and completion date
  • The full price sheet: base price, floor premium, GST, car parking, stamp duty and registration
  • The payment schedule and which milestones apply to your flat
  • The agreement for sale, read in full before any payment
  • The possession date in writing

A balanced view

No promises on returns

We do not promise rental income, price growth or returns. Property values can fall as well as rise, and exchange rates, taxes and holding costs affect what you earn or save. Decide on your own needs and take independent advice.

Tax and repatriation

Money, Tax and Repatriation

Tax on rent and on sale, and the rules for sending money abroad, depend on your situation and change from time to time. Repatriating sale proceeds is allowed only within the conditions set by the RBI and by tax rules. Speak to a chartered accountant who knows NRI taxation before you commit.
